Collection Services

Eberly McMahon LLC’s Collection Services practice uses modern technology to facilitate the efficient collection of consumer and commercial accounts. We use the CollectMax Win software to automate the collection process and facilitate client reporting and remittance requirements. Our approach is to listen to our clients’ needs and to create a process and a fee structure that best meets those needs. The firm’s Collection Services practice includes retail collection for creditors, collection agencies and individuals, including both small and large scale commercial collection cases. We handle collection matters for clients throughout Ohio, Kentucky and southeast Indiana.

While our office primarily focuses on collection through litigation, we also provide telephone collection and collection without litigation on lower dollar matters. In addition, we can provide a collectibility assessment through skip tracing and pre-suit collection activities and then recommend how to proceed. While most clients prefer to pay fees on a contingency basis, we also serve clients under other fee arrangements, including flat and hourly fees, or sometimes a combined flat or hourly fee with a contingency fee.

Subrogation

Our firm handles automobile, homeowners, and medical subrogation matters in a manner similar to commercial and consumer collection accounts. Our office makes an initial demand upon the tortfeasor and files suit within 30 days. We handle all facets and types of litigation for our subrogation clients, including product liability, negligent home repair, vandalism, automobile accidents, etc. Our goal is to obtain a judgment and to collect that judgment in the same manner as with other collection accounts. We efficiently collect judgments using suspension of driving privileges, bank and wage garnishments, judgment debtor examinations, and voluntary payment arrangements. Our collection-based focus in subrogation matters yields a larger recovery in most cases and allows for efficient tracking of litigation through all phases, including post-judgment collection.

Landlord Tenant

Eberly McMahon LLC represents a wide variety of residential and commercial landlords in the Greater Cincinnati metropolitan area. We differ from other firms because we can help our clients evict their problem or non-paying tenants and obtain and enforce a judgment against those tenants as in a typical collection case. Our experience includes Section 8 evictions in Kentucky and Ohio, representation of mobile home parks (including abandoned mobile home and title issues) and other standard eviction matters. We provide competitive pricing of these services and tailor our services and pricing to meet our clients’ needs.

Bankruptcy

Because debtors often file bankruptcy, there are times when creditors need representation in bankruptcy court. We routinely represent creditors in bankruptcy courts, handling all types of matters, including: motions for relief from stay, non-dischargeability issues, and defense of preference claims. We also represent clients at 341 meetings, in connection with the negotiation of reaffirmation agreements, and preparing and filing proof of claims. Our flexible billing arrangements enable us to represent creditors in bankruptcy court in a cost-efficient manner.
